Booking For Clubs - Terms of Service

Welcome to Booking For Clubs! These Terms of Service ("Terms") govern your use of the www.bookingforclubs.com website ("Site") and its services ("Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, please refrain from using the Service.
1. Membership and Subscription
1.1 Account Creation
Users can create an account on the Site without an invitation.
A 60-day free trial is offered, requiring no payment details.
Administrator users have the responsibility to create user accounts for their club members.
1.2 Subscriptions
Administrator users may purchase a subscription (Club or Syndicate) with options for monthly or annual payments.
Subscriptions are managed through Stripe.com, and payments are collected from the customer's credit or debit card on a recurring basis.
1.3 Payment Issues
If a payment cannot be collected, Stripe will reattempt collection three times.
After the final failed attempt, the account becomes "unpaid," and access is restricted.
The account can be reinstated by making payment within one month after the initial missed payment.
After one month, the club and its data, including all users, will be permanently deleted.
2. User Accounts
2.1 Account Confirmation
When an administrator creates a member's account, the member will be emailed a link to confirm their account and set a password.
2.2 Account Modification
Users can modify their information, including First name, Last name, Email, Phone number, and Second phone number.
2.3 Expiry Dates for Pilots
Administrator members can input expiry dates for pilots' class ratings and medicals.
Members cannot update this information to ensure physical document verification by Administrator members.
Members can view the expiry dates held for them.
2.4 Closing Accounts
Users have the ability to close their account, either from a specific club or the entire system.
3. Responsibilities of Administrator Users
Administrator users are responsible for creating and managing user accounts, including pilots, student pilots, and flying instructors.
4. Termination
The Service reserves the right to terminate or suspend access to the Site and Service, with or without cause, at any time.
5. Limitation of Liability
5.1 General Limitation
Booking For Clubs, its directors, officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the Service.
5.2 No Warranty
Booking For Clubs makes no warranties or representations about the accuracy or completeness of the content provided on the Site. The Service is provided "as is" and "as available" without any warranties of any kind.
5.3 Third-Party Links
Booking For Clubs is not responsible for the content of any third-party websites linked to from the Site. The inclusion of any link does not imply endorsement by Booking For Clubs.
6. Intellectual Property
6.1 Ownership
All intellectual property related to the Site, including logos, trademarks, and proprietary software, is owned by Booking For Clubs.
6.2 Usage Rights
Users are granted a limited, non-exclusive, and non-transferable license to use the intellectual property solely for the purpose of using the Service.
7. User Conduct
7.1 Acceptable Use
Users must adhere to acceptable and respectful conduct standards while using the platform.
7.2 Prohibited Conduct
Users are prohibited from engaging in any activities that violate legal or ethical standards.
8. Data Ownership and Usage
8.1 Ownership
Users retain ownership of the data they input. Booking For Clubs reserves the right to use the data to provide and improve the Service.
8.2 Data Usage
Booking For Clubs will not sell or disclose user data to third parties without explicit consent.
9. Indemnification
Users agree to indemnify and hold Booking For Clubs, its directors, officers, employees, and affiliates harmless from any claims, losses, or damages arising out of their use of the Service.
10. Dispute Resolution
Any disputes arising under or in connection with this Agreement shall be resolved through arbitration or mediation, as determined by Booking For Clubs.
11. Force Majeure
Booking For Clubs shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, wars, or acts of terrorism.
12. User Responsibilities for Security
Users are responsible for maintaining the security and confidentiality of their login credentials and other sensitive information.
13. Changes to Terms
These Terms may be modified at any time. Users will be notified of changes, and continued use of the Service constitutes acceptance of the modified Terms.
14. Notices
The official means of communication for important notices is through email or the Site.
